Terms of Service

By creating an account, posting influencer campaign briefs, sending direct messages, or using our secure escrow payment gateway, you explicitly accept all terms and conditions set forth herein. If you represent a corporate entity or brand, you warrant that you possess the requisite legal authority to bind that entity to this agreement.

Age and Capacity: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess full legal capacity to enter into binding agreements. BookMyCreator does not knowingly permit access to minors or anyone whose previous account has been terminated for terms violations.

To access our marketplace, you must complete the profile registration process. You agree to provide accurate, complete, and current information, including valid business tax IDs or legal names.

• Credential Confidentiality: You are solely responsible for maintaining the privacy of your account credentials (email, password, api keys). All actions, comments, and transactions executed through your account are legally attributed to you.
• Marketplace Integrity & Verification: BookMyCreator reserves the absolute right to verify connected social channels via third-party APIs. We may request proof of business registration, identity documents, and audience metric validations. Fraudulent metrics or purchased followers will lead to immediate account termination.
• Account Limitations: Each user or corporation is restricted to one active platform profile. The creation of secondary profiles to bypass fees, system bans, or negative ratings is strictly prohibited.

You maintain ownership of all creative assets, campaign briefs, and portfolios you upload. However, you grant BookMyCreator a non-exclusive, royalty-free, worldwide license to host, display, and analyze this content for platform operations and aggregate statistical reports.

Prohibited Conduct: You agree not to post, share, or direct message content that is defamatory, deceptive, explicit, hateful, or designed to infringe upon third-party copyrights. Attempts to scrape creator directory details, reverse-engineer the matching algorithm, or spam other members are strictly prohibited.

Content Moderation: BookMyCreator reserves the right to review, restrict, or remove any brief or profile at our discretion. Automated systems are deployed to scan messages for offensive terms, replacing identified profanities with asterisks to maintain professional standard communication.

BookMyCreator acts as a digital infrastructure facilitator. All collaboration agreements, content specifications, and milestones are directly binding agreements between the Brand and the Creator. BookMyCreator is not a party to these contract relations.

• Escrow Gateway Operations: To initiate a campaign, the Brand must deposit the agreed budget into the BookMyCreator Escrow system. Funds are securely locked and will only be released to the Creator upon automated deliverable verification or manual Brand confirmation of brief requirements.
• Dispute Mediation Policy: In the event of disputes over campaign deliverables, either party can request BookMyCreator mediation. BookMyCreator will review the brief, the chat transcripts, and the uploaded content. Decisions made by BookMyCreator mediation regarding escrow payouts are final and binding.
• Platform Fees: BookMyCreator charges a service fee on transactions to maintain digital infrastructure. All fee schedules are visible prior to escrow deposits and are non-refundable once escrow funds are active.
• Taxes: Users are solely responsible for reporting and paying all income, sales, or self-employment taxes arising from payouts received on BookMyCreator.

Disclaimer of Warranties: The platform is provided "as is" and "as available". We do not guarantee uninterrupted server uptime, absolute data synchronization speeds, or complete freedom from code bugs.

Limitation of Liability: To the maximum extent permitted by law, BookMyCreator is not liable for indirect, incidental, or consequential damages (including loss of business revenue or audience reach). Our total liability for any claim is capped at the service fees paid directly to BookMyCreator by you in the 6 months preceding the claim event.

Amendments: We reserve the right to modify these Terms of Service. Revised documents will be published here with an updated effective date. Your continued utilization of BookMyCreator tools constitutes your binding acceptance of the updated Terms.
